Abstract

The petitioners, heirs to the estate of the late Richard Ward, ask that the slave property of said estate be distributed. At his death, Ward left his estate, which included slaves, to his widow, Sarah, with the proviso that each child would get his/her distribution upon coming of age. The petitioners say that Sarah failed to distribute their shares of the estate during her lifetime and now, after her death, they find that William Ward, the defendant, convinced her that Richard Ward had used the property as security for prison bonds, thereby subject to levies once the case for which it was security was settled; when said case settled, the estate's property was sold by the sheriff and purchased, in its entirety, by William Ward. Each petitioner contends that they are entitled to one-ninth of the estate, and they ask the court to require Ward to distribute it accordingly.
