Abstract

Charles and Mortimere Williams, merchants, state that David L. Curtis owes them $800, plus interest, for "value received." They seek $1,600 damages. Curtis refuses to pay the debt, claiming that the three slaves for which the note was written were fraudulently represented: "the first named was almost if not quite an idiot ... the woman ... was not in the family way but was past the period of life when it is usual for a woman to bear children, and the boy child was less than three or four years old."

Result: Partially granted.
