Abstract
In 1846, Charles and Mortimer Williams purchased three slaves, Robert, Cherry, and Willey, from William Dearmond and John King. They then sold the slaves to David Curtis. Curtis gave them an $800 promissory note, but when the petitioners sued Curtis for payment, they were informed that the slave, Robert, was an "idiot" and "of no value." The petitioners claim that the debt has not been fully paid and a balance of $426.70 is due. They argue that when they sold the slaves to Curtis they were unaware of Robert's condition because Dearmond and King led them to believe that the slaves were sound. They charge Dearmond and King with fraud and seek the amount lost on Curtis's note.
