In 1844, Henry Fuqua "casually lost" a slave, Rina, valued at $700, and holding a yearly value of $100 for hiring. Rina has been in the possession of Nathan Tucker and has since had three children. Tucker has refused to return the slaves to the petitioner. Fuqua filed an equity suit in 1844 "to recover three fifths of the value of said negro woman said defendant owning the other two fifths." The case was dismissed on the grounds that it was a common law suit. The petitioner avers that the "six months" has not yet expired since the dismissal and he continues to seek $1,800 in damages.
