Cobb invested $2,000 in the business and served as the partnership's speculator.  It was agreed that Cobb would pay one-half of the net profits from the sales as well as repay his $4,500 investment.  In 1845, Pertut expressed his desire to terminate the operation and asked for the $4,500 and his share of the profits.  Now he has died and William Pertut, administrator of his estate, complains that Cobb still refuses to settle the account.
