Abstract

Nancy Strother seeks to reclaim Morton, a slave levied upon as the result of debts made by her husband, Joseph Strother Sr., and sold at auction to her son, Joseph Strother Jr. She claims that Morton was one of three slaves given to her by her son, Benjamin, for the benefit of her and her family, clear of any debts made by her husband. Strother explains that her husband is "now in a deplorable state of Derangement & thereby renderd perfectly incompetent," making Morton necessary to the support of the family. Although Joseph Strother Jr. made it known publicly that he was purchasing Morton for the benefit of his mother, she says that her son is "about to go down the river to Orleans" and she fears he will sell Morton there. She asks that the court set aside the sale of the slave and protect her rights to him.
