Abstract
John Hutcheson and other heirs of the late John Hutcheson Sr. seek settlement and final distribution of the estate, which consists of "real and personal" property, including slaves. They ask the court to issue an injunction to Jenny Kinsler and William and Mary Crosthwait, restraining them "from disposing of, removing or secreting" the slaves of the estate, which remain in their possession following the death of Mary Hutcheson, widow of John. The heirs ask for an equal division of the slaves, "or if the same will not admit of equal division, that a sale thereof may be decreed & the proceeds of said sale may be divided with each legatee."
Result: Granted; appealed; reversed.
