Abstract

Henry Field, owner of a slave named Judy, bargained with James A. Sturgus Jr. for a wagonload of salt, using Judy as security to be redeemed when Field had repaid the debt. When Charles Beeler offered to provide security for Field, they agreed that Beeler would pay off the debt to Sturgus and keep Judy until Field reimbursed him. Field states that after Beeler died, he attempted to settle the debt with Beeler's administrator, but that "John Beeler absolutely and very dishonestly too, refused to give up the said slave and her child or children." Field asks that Judy and her increase be delivered up to him or an award of damages be awarded as determined by a jury.

Result: Granted; appealed; remanded; upheld.
