Abstract

In 1773, Rawleigh Gibson died, leaving his estate, including a slave named Dilla, to Anne Howard, Absolam Creel and Priscilla Gibson. Priscilla Gibson executed his estate and "possessed herself of and retaind the said slave and her subsequent increase which was Ten in number," making no division with Creel or Howard. At Gibson's death, her entire estate, including Dilla and her children, went to her illegitimate daughter Elizabeth Sucket, who married James Scott. Since then, Thomas Howard, the husband of Anne Howard, acquired two of Dilla's sons from Elizabeth Sucket Scott. Absolam Creel died in 1802, bequeathing the whole of his estate to Polly Pullen, one of the petitioners. Thomas Howard is now dead, as is James Scott. William and Polly Pullen ask that Elizabeth Scott and the executors of Thomas Howard and James Scott answer their allegations about the fair distribution of Dilla and her issue and that the court order a division of the slaves in question according to the will of Rawleigh Gibson.
