Abstract

James D. Breckenridge seeks to recover a debt of $120 owed to him by William Vernought. Breckenridge claims that Vernought has left the state but that he "is legally entitled to one third part of the negroe slaves of Asahel Linn." Vernought married Linn's widow, now deceased, and is thus legally entitled to her dower portion of Linn's estate. Breckenridge says that Polly and John McArthur, Linn's daughter and son-in-law, are suing for division of the slaves with the intention of depriving Vernought and his creditors of his share of the estate. Breckenridge asks the court to hold these slaves subject to Vernought's creditors.
