Abstract

Henry Harrison sues George W. Dale Jr. for the possession of three slaves named Hannah, Edmond, and Jacob. Harrison states that Dale "took and carried away secretly" Hannah and Edmond; Dale had possession of Jacob because he had hired him from Harrison earlier. Dale claims to have a bill of sale for the slaves, but Harrison claims that it was obtained fraudulently. He claims "that he is an illiterate man, the natural strength of whose mind was greatly weakened and impaired by an unfortunate habit of intemperence." Harrison thought he was signing an agreement for the hire of Jacob when in reality it appears that he signed the bill of sale. He claims that he "has a wife and helpless children to maintain, and if the Deft. is suffered thus, by fraud & and strategem without consideration, to strip your Orator of his slaves, his family's chief and only support they must inevitably suffer." Harrison asks the court to cancel, annul, and set aside the bill of sale and to decree that the slaves be returned to him.

Result: Dismissed.
