John Barry claims that he became entitled to one-third interest in a slave named Frank upon his marriage to Susanna Roberts, as an heir to Thomas Roberts. Barry then purchased a second third interest from John and Nancy Sanford, Robert's daughter and son-in-law. Using the proceeds of Frank's hire, Barry then purchased a slave named Nancy, who has three children: George, Mary and Sylva. The other third interest in Frank is vested in Anthony and Elizabeth Roberts Benning. For the past ten years, "through motives of friendship," Barry allowed Benning to retain possession of Nancy and her children. Barry now asks that court to "decree a division of said slaves" and to prevent the Bennings from removing the slaves out of the jurisdiction of the court.
Result: Granted.
