Clement Montague, the father of the plaintiffs, died intestate, "leaving a considerable estate both real and personal." Their mother Sally, now Sally Daviss, is the administratrix of the estate. The plaintiffs ask that "for the purpose of a more fair and equitable division" the court order the sale of their deceased father's slaves and land, the proceeds from which will be distributed among the heirs.
