Abstract

William Eldridge hired a negro woman, Lucy, from John Hutchison. Hutchison represented her as "a first rate house servant," but Eldridge found her to be "directly the reverse." He returned Lucy, and Hutchison's son agreed to rescind the contract, but did not return the note, promising to do so later. The note became due when Eldridge was out of town on a trading expedition and Hutchison brought a successful suit against Benjamin Keiningham, who secured the note. Not knowing the contract was rescinded, Keiningham executed a replevin bond for the judgment. Eldridge asks the court for an injunction restraining Hutchison from collecting on the judgment or replevin bond until this case is heard.

Result: Dismissed.
