David Richardson claims that he purchased from Thomas and John Scott their interest in slaves from their grandmother's dower estate. Richardson made the purchase only after he was assured by their father, Thomas Scott, that he had no interest in the slaves. Now Richardson fears that the elder Scott will claim an interest. Richardson asks that Hugh Roseberry, who holds the proceeds from the sale of the slaves, be restrained from paying Scott the $350, which represents the proportional share of Thomas and John Scott, and that the money be decreed to Richardson.
