Newton, a twelve-year-old slave, who sues by his next friend Archibald Duncan, claims that in 1833 Duncan sold him for $200 to Daniel Musser "to Serve Said Daniel Musser until he arrived at 31 years of age at which time Said Musser was to Set your orator free." Musser, however, has sold Newton as a slave for life to Joseph Thompson, "a negro trader," and Newton believes Thompson will transport him to the lower country "and put it out of the power of your Orator when he may arrive at 31 years of age to assert his right to freedom." He asks that the defendants be restrained from removing him or "from disposing of your orator in any manner prejudicial to his rights."
Result: Settled.
