Abstract

The petitioners are the heirs of William Davis, who died intestate in 1837. They state that Davis had been "a person of great industry, active, intelligent, and attentive to his business," but that for many years before his death "he had fallen into habits of excessive intemperance" and that by the time of his death "his mind was entirely prostrated, and he sunk into a settled state verging upon idiocy." The defendant John Davis continued to live with his father, and the plaintiffs charge that by a series of deeds of conveyance John fraudulently obtained the whole of William's property, including land and slaves, "to the utter disinheriting of the other Children." They ask the court to declare the conveyances null and void "from the imbecility of the grantor," to decree a partition of the land among all the heirs, and to ascertain the annual value of the land and to charge that against John Davis's share.
