Abstract

In 1841 Robert Davis and William H. Smith received a judgment against Elijah Porter for $143.13 plus interest and court costs. The sheriff's attempt to levy upon Porter's property failed as the sheriff's return cited "no property found." Davis and Smith assert that Porter owns a slave named Sam, previously mortgaged to William Carson, but now subject to the court order because the mortgage has been paid. They also allege that Porter owns several tracts of land. Davis and Smith ask the court to determine "every cent he [Elijah Porter] is worth on earth." They ask the court to sell Sam and Porter's other property to pay Porter's debts. Finally, they seek injunctions against the defendants to prevent them from disposing of Elijah Porter's property before the case is decided.
