Abstract

William P. Payne, the executor of William R. Payne's estate, charges Esther Jones with defaulting on a debt. Jones mortgaged a house and lot in the city of Bowling Green, but Payne asserts that the property is not enough to satisfy the full debt. He asserts that Jones has a life interest in five slaves, one of whom is hired out for the year 1848 to John B. Clark, at $60 per year; another is hired out to V. C. Durham for $30. As both men are indebted to Jones for the aforesaid amounts, Payne seeks to receive the proceeds from the hire of the slaves to apply to the outstanding debt.
