In 1851, William Graves purchased a purportedly healthy slave named Jack from James Kelly. Graves states that "Jack was not at the time of said sale and purchase sound and healthy, but on the contrary was sick and unsound, and had been so for some time prior thereto, and has so remained and continues ever since, in consequence of which he has been and still is of no use or value." Jack "was sent to the south" where he required and received medical treatment that cost $300. Graves notes that Kelly rejected his offer to retrieve Jack and "return said boy to the defendant & rescind said contract provided [Kelly] would agree to pay the expenses he had already incurred & of bringing him back." Graves seeks monetary damages of $1,000.
