Abstract

The heirs of the late Isabel Nelson "contend that the Will made by Isabel, and the bill of sale by which she transferd to Deft the said slaves & all the other transactions and dealings of Deft Isaacs with Isabel Nelson are void, illegal and ought to be cancelld, because they were obtained by fraud & falsehood & misrepresentation." They further point out that said transactions were "made and done and procured without any consideration, & without the knowledge or consent or concurrence in any way of her husband W. H. Nelson and because she then being a married woman had no power or authority to execute such will or Bill of sale or note or bond." The petitioners fear that Isaacs will dispose of the property he obtained from Isabel's will, and they ask for an attachment; included in the property are three slaves. The plaintiffs "state that Deft brought a suit in the Jefferson Circuit Court for the negro woman Nancy & took her out of Nelson's possession." The petitioner seeks a cancellation of the assignment of property and $500.
