Abstract

Jacob Renaker Jr. states that he purchased "a negro woman named Sarah and her two children Mary Ann and Samuel for the sum of $1400" from J. M. Kimbrough on 3 December 1857. He attests that Kimbrough wrote that he warranted "Sarah and her boy child Samuel to be sound in body and mind and slaves for life, the girl Mary Ann he takes as she is I do not warrant the soundness of her but I warrant her a slave for life." The petitioner charges that "the negro woman Sarah was much unsound and labouring under disease, under which she laboured and suffered until the 17th day of January 1858 when the said disease terminated in the death of the said Sarah." He charges Kimbrough with fraud and seeks $1,000 in damages.
