Abstract

James Batterton's will devised his large "estate consisting of Lands and Tenements situate in the State of Illinois and in the counties of Bourbon and Nicholas in this State and negroes and cash notes and personal property," to his widow, Mary Jane, and their children. Prior to their marriage, James and Mary Jane Batterton entered into a marriage contract indicating that the value of property and slaves owned by her at that time was $6,000. Now the petitioners ask the court to appoint commissioners to help determine what part of the estate is covered by the marriage contract and how the remainder is to be valued and allocated.

Result: Granted.
