Abstract

William Frank, a free man of color, relates that on 11 September 1809, John Baptist Juge "by force of arms & with malice and intention to injure your petitioner ... did beat, wound, bruise, kick and maltreat your petitioner to his great damage in the sum of three thousand dollars." Frank avers that the beating was unprovoked and that he "always hath been a good, peaceable worthy, honest citizen." Frank prays for compensation. In his answer, Juge states "that it is not true that the Said Frank is a good peaceable worthy and honest citizen of this Territory, that on the contrary the said Frank has always born the character of a bad restless unworthy and Turbulent man, that it is equally false that the said Frank is a Citizen of this Territory Since he is well known to be a man of Colour." Juge continues that, on 11 September, Frank "did so abuse, and provoke" him that "he thought it necessary to correct the Said Frank with moderation."
