Abstract

John Lion seeks to cancel the sale of a slave. Lion represents that in October 1812, he purchased a slave named Bonaparte from Martin Dubourg for $350. Dubourg warranted the slave free "of all default." However, "at the very moment of the Sale the same negro was then recovering of a Pretended Cold," for which a surgeon had fixed "a cautery on his right arm." Both the surgeon and Dubourg assured Lion that Bonaparte would be healthy enough to perform his work. However, "soon after the sale your Petitioner perceived that the said Negro was Laboured by a lax ... which untill now threatens his life and would be sufficient to render his Service absolutely inconvenient and difficult, were he not subject to any other defect." Within a month of the sale, Lion realized that Bonaparte "was affected with a weakness" which rendered him unfit for any kind of labor. Lion states that he "would have not bought him at all if he had been acquainted with these defects." He charges Dubourg with fraud and prays that the sale be annulled and that Dubourg be condemned to repay the purchase price plus interest and $200 in damages.
