Abstract

Jean Jacques Paillette and Caezer Murphy, representatives of the heirs of Marie Anne Buard Rouquier, seek the return of their clients' inheritance. At the time of her death, Marie Anne Rouquier possessed considerable paraphernal property, as well as half the property she held in community with her husband, Francois Rouqier. The property consisted of money, land, and slaves. The slaves were part of her separate "paraphernal" property. The petitioners claim that, after Marie Anne's death, Francois Rouguier "illegally Detained” the property to their injury and damages. Furthermore, the petitioners believe that Rouquier may transport the slaves out of the reach of the process of the court. They therefore pray that the court order sequestration of the property or direct Rouquier to give financial security on the condition that he will not dispose of it until the court has ruled on the matter.

Result: Dismissed.
