Abstract

Manuel Sr., Michel, and Hoster Audry ask the court to rescind their purchase of nine slaves from Prosper Foy. The plaintiffs state that they purchased the slaves upon the warranty of Foy who represented the "negroes as very good characters." They charge that Foy knew at the time of the sale that the slaves were "notoriously bad Characters, adicted to every sort of vice or defect and in the habit of running away from their masters." Since the sale, six of the slaves have runaway and only three have been captured. The plaintiffs pray that Foy be made to take back the slaves and return their note for $10,500.

Result: Partially granted; appealed; partially affirmed.
