Abstract
The petitioner is a slave named Maria. She presents to the court that the last will and testament of the late Erasmus Robert Avart directed his testamentary executor, Robert Avart, to use funds from the estate to purchase her and her son Gaston from their current master, Nicholas Lauve, with the express intent to emancipate them. Maria also states that Nicholas Lauve is indeed willing and ready to sell her and her child for a "reasonable price." She prays the court to call upon Robert Avart, the executor, to declare whether or not he intends to fulfill the provisions of the will and, if he refuses, to appoint "some fit and suitable person, granting him the necessary powers to carry the said will to Execution."
Result: Granted; appealed; remanded; reversed; appealed.
