Abstract

Marie Therese, a free woman of color, represents that she and John Mc Ilvain, a merchant, jointly entered into a bond as security for a certain sum of money delivered to Marie Therese as presumptive heir of the estate of her absent "natural," i.e., illegitimate, son, Pierre Maurice. To secure the bond, Marie Therese gave John Mc Ilvain $600. In return, he agreed to refund the money within three months of having received notice that the bond had been cancelled and to regularly pay her interest on the loan in the meantime. Marie Therese claims that, although the estate is now settled and Mc Ilvain has been instructed to return the sum, he has "neglected or refused" to do so. She therefore asks the court to require Mc Ilvain to refund the $600 with interest at "ten per cent" per annum and costs of suit.
