Abstract

Victoria Stark petitions for a separation of bed and board from her husband, William Stark, and a division of their "community property." Since their 1808 marriage, the Starks have acquired considerable property through purchase and improvements to their land. Their current estate contains a plantation, farming equipment, livestock, and nine slaves, including Luke, a blacksmith. Victoria has been "compelled to leave their common dwelling because of her husband's cruel" treatment, which includes "beating, striking, choking, & gouging," as well as public defamation of her character. Victoria Stark prays for a separation of bed and board, and of the community property, plus the recovery of her dotal property amounting to $404.50. She asks that William be enjoined from selling any of the property until the suit can be settled. She also asks for a monthly stipend to support herself during the duration of the suit. In his answer, William accuses Victoria of adultery, public drunkenness, and verbal abuse.

Result: Granted; appealed.
