Abstract

Achille, Aglaë, Valcour, Patrice and Elizée Burel, all free people of color, are the heirs of a woman of color named Benedicte Burel, who died in 1810, and of a man of color named René Foucher, who died intestate in 1814. Achille is Benedicte and René's brother; the other four petitioners are Benedicte's children. Achille claims to be entitled to a seventh of his late brother's estate. Aglaë, Valcour, Patrice and Elizée claim to be entitled to another seventh of their uncle's estate by "representation" of their late mother. The said estate consists of $3,219.59, which the minor René Foucher had inherited from the succession of his late mother. The funds were placed in the hands of his curator, Barthelemy Lafon, who died in 1820 without discharging the debt. The petitioners claim to have "amicably demanded" settlement of the debt from Lafon's testamentary executors, Jean Gravier and Jean Poumairat, but to no avail. They therefore pray that Gravier and Poumairat be decreed to pay, with interest, their share of Foucher's inheritance, which amounts to $919.87.
