Abstract

Ann Miller seeks permission to sue her husband, Jacob Miller, for a divorce and for separation of property. She informs the court that, “at divers times,” she has “suffered under severe and alarming indisposition.” “Being sick and requiring constant medical aid and attendance,” Ann came with Jacob to Baton Rouge “for the purpose of undergoing a course of medicine.” Jacob left Baton Rouge, but returned a few days later and “abused” her in “the most cruel manner.” He ordered her to go home and declared that “if she did not go then she never should.” Ann was “unable to be moved & in a very low & dangerous situation.” Jacob abandoned her, taking a cow, a “servant girl,” and their oldest child. Ann prays for a judgment against Jacob ordering him to pay $500 for the value of household goods she brought into the marriage, $800 “due by marriage contract”, and $1,000 for her half of their community property. In addition, she asks for custody of the children, for an order directing Jacob to provide her with “a servant girl,” and for an “allowance sufficient for her support.”
