Abstract

Marguerite Charlotte Cabaret sues her husband, Albin Michel, for a separation of property. As evidenced by her marriage contract, Cabaret brought $11,000 and one mulatto slave named Lise to her 1808 marriage. Since then, her father gave the couple an additional $3,000 in anticipation of Marguerite’s “rights to his estate.” Marguerite’s father has since died and Albin Michel has “received the proceeds of the Property inherited” by his wife. In addition, there are six slaves that have not “been aliened,” but are in Michel’s possession. Marguerite informs the court that her husband’s “whole Estate” is “not sufficient to pay & satisfy” her claim. In addition, “several creditors are about to sue & obtain Judgments” against Michel, “who is now in failing circumstances.” Fearing that her property is “in danger of being lost,” Marguerite asks the court for a “separation of goods & Estate” and for a judgment against her husband for the sum of $43,266.23.

Result: Denied; appealed; appeal discontinued.
