Katherine Living petitions in her own right and as tutrix of her three minor children. She seeks to annul the purchase of a slave made by her late husband, William Stark. Katherine Living Stark states that her husband bought three slaves named Jane, Edward, and Daniel from Joseph Erwin in 1828 for the aggregate sum of $1,200. Erwin warranted the slaves against vices and defects; however, the Starks soon discovered that Daniel was both "crippled in the left hand or arm" and afflicted with chronic asthma. Katherine attests that Daniel's conditions render him "rather a charge than a profit." She prays that Erwin be compelled to take back Daniel and to repay the purchase price plus damages.
