Samuel Diton, a free man of color, contends that he is "unlawfully imprisoned and detained" in the Baton Rouge jail "under pretext of a judicial order." He states that the order "was grounded on a law passed by the legislature of the State of Louisiana in contradiction and opposition to the Constitution of the United States." Therefore, Diton believes that the order and the law it is based upon are "inapplicable" in his case. Diton prays for a writ of habeas corpus. He also asks to be discharged from jail.
