Abstract

Hélène Dupuy prays for a separation of bed and board from her husband, Joseph Rimbaud, and the return of the property she brought into the union by marriage contract. Dupuy avers that, over the last three or four years, Rimbaud has been guilty "of excesses, and treatment & outrages” towards her “of such a nature as to render their living together unsupportable.” Hélène claims she has been obligated “to quit & run from the common dwelling house, sometime in very bad weather & in night time in order to escape the abuses of her said husband.” In addition, she attests that Rimbaud has publicly defamed her by calling her “a hore, a bad woman & a prostitute,” and by stating that she “had co-habited & did co-habit & had sexual intercourse with others than" him. Hélène claims that she brought substantial property into the marriage, including a plantation, eleven slaves, and various sums of money. In addition, during the marriage she inherited $2,606.67 from the estate of her first husband, Armant Hébert. Hélène prays for a divorce from Rimbaud and that the property she brought into the marriage be decreed her “exclusive & personal property.”

Result: Granted; motion for new trial.
