Abstract

Benjamin Poydras de la Lande seeks the seizure and sale of two slaves belonging to Louis Aicard, in order to recover an unpaid debt. Poydras de la Lande represents that, in 1826, he and Charles Morgan sold to Aicard, for the sum of $1,120, a female mulatto slave named Menarie and her daughter named Amelie. Payment was due in March 1826. By 1827, Aicard had not paid the debt. A “notarial” act was then entered into, whereby Aicard and his wife, Eugenie Langlois, agreed that Menarie and Amelie would remain mortgaged to Poydras de la Lande until the debt had been fully paid. To date, the Aicards have not paid the debt. Poydras de la Lande therefore wishes to exercise his right of mortgage on the slaves. He prays that Menarie, Amelie, and the three children born to Menarie since the sale, be seized and sold to satisfy the debt.
