Abstract

Marie Pelagie Bourq seeks a separation of bed and board and a partition of the community property from her second husband, Louis Daigle. Bourq, a widow, insists that she has been a “faithful, affectionate & obedient spouse” since she married Daigle in 1832. However, in light of her husband's “ill treatment & excesses & outrages" towards her "she finds their living together any longer entirely insupportable.” She claims that Daigle has been in the habit of abusing her “by calling her by the most opprobrious & degrading names & cursing her.” In addition, Daigle “directed” her to “leave their common dwelling,” and warned that if she refused he “would have a partition wall build in the house," so that hey might live separately. Marie Pelagie also charges that Daigle “permits his servants to insult and ill treat” her and he refuses to “chastise" their "insolence" toward her, saying that she was “unworthy his protection.” She therefore is “desirous to be separated from bed & board & of property from her said husband” and asks that an inventory and appraisement be made of all community property in order to “recover what is due to her for Separate Estate.”

Result: Denied; motion for new trial.
