Abstract

Mary Thames petitions to sue her husband, Vincent Carr, for separation of bed and board, a partition of the community property, and the return of her "paraphernal" property. Mary states that while she has “conducted herself as be came a faithfull and virtuous wife endeavoring by every means in her power to secure the happiness of her said husband her children and herself,” Vincent has “frequently & repeatedly beaten and abused her.” She contends that his conduct towards her has been so "cruel and inhumane” that she finds living with him any further “insupportable.” She further charges that she has “the greater part of her time been compelled to leave her house & children to avoid the ill treatment.” Fearing the disposal of the communal property by her husband, Mary prays for a sequestration of the property consisting of land, slaves, and livestock until the termination of the suit. In addition, Mary asks to retain custody of her children who, she claims, are of “a tender age and requiring a mothers Care and attention.”
