Abstract

James Pipes petitions to recover a $400 debt from John Nolan. Pipes represents that he agreed to hire out a slave named Henry, a cooper, to John Nolan, from September 1838 until the following January. James Pipes contends that, although he was badly in need of Henry’s services to gather his cotton crop, he consented to part with him because Nolan promised to replace him with one of his slaves, a good cotton picker. Nolan never supplied the promised cotton picker. As a result Pipes was unable to pick all his cotton and had to leave more than ten bales in the field, causing him to lose $400. He claims to have amicably approached Nolan to settle the dispute, but to no avail. He therefore seeks $400 in damages, plus costs of suit.

Result: Denied; motion for new trial.
