Abstract

Arnaud Decuir, Remy Decuir, Adéline Decuir, Delphine Decuir Pollard, and Antoine Pollard, all free persons of color and "legal heirs" of Léandre Decuir, also a free man of color, present to the court that a free woman of color named Fançoise Lorken is indebted to them in the sum of $3,000. They claim that, in 1838, Lorken purchased a family of five slaves, property of the late Léandre Decuir's estate. Lorken signed three promissory notes of $1,000 each, payable in March 1840, 1841 and 1842, respectively. A condition of sale stipulated that the slaves remain mortgaged to the estate until "full and punctual payment" of the debt. The heirs charge that, although the first note has now "fallen due" and amicable demand for payment has been made, Lorken has refused to pay. They therefore pray for a judgment in their favor for the sum of $1,000 each, with interest at 10% per annum, and they ask the court to recognize their "special mortgage and vendor's privilege" on the slaves.
