Abstract

Adelle Simien, a free woman of color, seeks a separation in property from her husband, Joseph Provost. Adelle represents that, at the time of her marriage to Joseph Provost in 1829, she owned property valued at $900, consisting of cattle and horses branded with her initials, as well as money. In 1831, a document was signed before a duly commissioned Notary Public, whereby Joseph acknowledged receipt and safekeeping of the $900 on behalf of his wife. Adelle Simien Provost now contends that, owing to “misfortunes and mismanagement,” her husband’s affairs are in such disorder that his estate may not be sufficient to meet her "rights and claims." She therefore seeks to be separated in property from her husband and asks for a judgment against him for the sum of $900. She also asks for an order declaring the branded horses and cattle her separate property. Furthermore, she seeks a “legal” mortgage on her husband’s immoveable property and a privilege on his "moveables." Finally, she asks that her husband be condemned to pay the costs of suit.
