Abstract

Merrick Meuillon, a free woman of color, sues Robert C. Hynson for compensation for a violent attack by his slave, John. Meuillon informs the court that John assaulted her with "spears, knives, clubs and other weapons." Her injuries from the attack consisted of "divers large incissions, gashes, contusion, and other grievious wounds." As a result, Meuillon "has lost the use of one of her arms entirely and forever- was bedridden for several months, and compelled to employ Physicians and nurses at great expense." Meuillon asserts that, according to the laws, Hynson is responsible for the injuries caused by his slave. Therefore, Meuillon requests a judgment ordering Hynson to pay $1,000 in damages. Related documents reveal that, upon a verdict in favor of Merrick Meuillon, Robert Hynson abandoned his slave to her, so that she could sell him and use the proceeds to pay her medical bills.

Result: Granted by default; judgment set aside on motion for trial by jury; found for plaintiff; motion for new trial.
