Abstract

Joseph Lallande seeks to recover a debt from Wallace Badger. Lallande represents that, on the 23rd of November 1843, he sold to Badger a plantation “with a number of slaves” on it for the sum of $15,000, for which Badger furnished promissory notes. When the notes became past due, Lallande obtained a judgment against Badger. The plantation and slaves were seized by the sheriff and Lallande regained ownership of his plantation and slaves. He found out however that Badger had failed to pay taxes due the parish and the state for the years 1844 and 1845 when the property belonged to him. In order to avoid seizure of the property, Lallande paid the taxes. He now seeks an order directing Badger to reimburse him for the sum of $103.24.
