Abstract

Robert C. Hynson seeks an injunction on the sale of his property and a judgment for damages. In a previous suit, Merrick Meuillon, a free woman of color, sued Hynson for what he calls a "quasi offense committed by his slave." Because of this suit, the sheriff has seized and is about to sell Hynson's plot of land in Alexandria. Hynson now says that the seizure was illegal. In accordance with the order of the original suit, Hynson publicly gave up the rights to his slave to Meuillon, thus avoiding the payment of damages. The slave is now in New Orleans "undergoing punishment awarded to him by the verdict of a Jury." Hynson requests a writ of injunction restraining the sheriff, Leroy A. Stafford, from selling the property. In addition, Hynson asks for a judgment against Meuillon for $200 in damages for the illegal seizure.

Result: Granted; appealed.
