Abstract

Theophile Louis Metoyer, a free man of color, presents to the court that Athanasse Pierre Metoyer, also a free man of color, is indebted to him in the sum of $1,000 plus interest, at 10% per annum from June 8, 1840. On that day, Athanasse Pierre Metoyer wrote two promissory notes, in the amount of $500 each, to the order of J. Bte. Dque Metoyer. The two notes were payable in 1841 and 1842, respectively, and the debt was secured by a special mortgage on Athanasse's thirty-five-year-old slave, Joe. However, before either note had reached maturity, the debt was endorsed by and delivered to Theophile Louis Metoyer, the petitioner. Theophile alleges that, although "amicable demand" has been made, Athanasse Pierre Metoyer has so far refused to pay the debt. Claiming to be "empowered to enforce" the mortgage, he prays the court to cite Athanasse Pierre Metoyer to answer "interrogatories" under oath. He also asks the court to order that the mortgage be "recognized, allowed & enforced" to pay for the $1,000 debt plus interest.
