Abstract

The heirs of the late Rosalia Pino, wife of Michael Granery Sr., seek a right of mortgage on a slave. Augustine Granery Barker, assisted by her husband Daniel Barker, and her three minor siblings, represented by their under tutor, Joseph J. Pino, represent that, as heirs to the community of “acquets and gains” that existed between Rosalia and Michael Granery, they are entitled to the undivided half of a female slave named Maria, also known as Puss. They claim that Maria has been seized by the sheriff, Leroy C. Morris, to satisfy a judgment against their father in favor of one Elizabeth Theriot; an action that prejudices their rights as Maria’s half owners. They therefore pray that Elizabeth Theriot and Leroy C. Morris be restrained from further action in recognition of their right of mortgage on their half of the slave.
