Magdeleine, a free woman of color, seeks to recover her inheritance from her late mother’s estate. Magdeleine represents that, when her mother died in 1838, Victor Duperron, a free man of color, was appointed her “dative tutor” and, as such, received from her mother’s estate the sum of $4,180 to be administered on her behalf. Magdeleine has now reached the age of majority and she wishes to receive her inheritance. She therefore asks the court to order Duperron to provide an account of his administration. In addition, she requests that a mortgage be placed on Duperron's property until the inheritance is paid.
