John P. Kauffman seeks to collect a debt from Jackson F. Libby. Libby executed to Kauffman a promissory note for $400 plus 8% interest, the value of which was due on 1 January 1848. Kauffman informs the court "that the defendant, in order to secure the payment of said note made and executed a certain mortgage and privilege upon Henry a negro man aged about 21 years & Harry of 23 years." The note is now past due; therefore, Kauffman prays that the slaves be seized and sold to satisfy his claim.
