Abstract

Theresa Montgomery, widow of Robert Piety, represents that she is the "tutrix by nature and Confirmation" of her two sons, Randoph and Francis Piety. She explains that her oldest son, Randolph, is within four months of the age of majority and will soon require partition of his father's estate, which consists of some land, household goods, farming equipment, and three slaves. She claims that she is unable, under the present circumstances, to manage the property to the best interest of her children and therefore wishes an immediate partition of the estate and to relinquish her tutorship. She therefore asks the court to appoint a new tutor and to order the convening of a family meeting to deliberate on what needs to be done with the estate. Theresa Piety indicates that a partition of the three slaves, a mother and child and a young boy, is "practicable" without a sale.
